- The Legal Assistance service (available at www.assistenzalegale.ch ) is managed by Enea Scarpino, MLaw ( jurist ). The office is located in Chiasso, at Via Pioda 2/A.
- Legal assistance and advice services are provided by jurists , not lawyers . The lawyer's fee, CHF 90 per hour, is therefore lower than that of lawyers.
- The lawyer will be able to represent the client in all administrative procedures, including judicial ones , in particular before the Council of State (CdS), the Cantonal Administrative Court (TRAM) and the Cantonal Insurance Court (TCA).
- The lawyer cannot , however, represent the client in civil or criminal proceedings . However:
- In civil matters, however, the lawyer may handle matters out of court (i.e., before the case is brought before a judge), representing the client in dealings with the opposing party with the aim of seeking an amicable resolution of the dispute, asserting claims, initiating enforcement proceedings, negotiating, or handling other similar activities, before (and until) the case is brought before a civil judge . Once the civil proceedings become judicial (initiation of the lawsuit/submission of a conciliation request), the client may decide whether to proceed without the representation of a lawyer, thus appearing personally in court as a party (and, if necessary, having the documents to be produced in court reviewed by a Legal Assistance lawyer), or whether to contact a lawyer and grant him or her a mandate to represent them in court.
- In criminal matters, the lawyer cannot represent the client before the authorities. However, he or she may provide legal opinions in individual cases, assist in drafting documents, which must be signed by the client, and assist in drafting complaints, reports to the Public Prosecutor's Office, and defense briefs in minor/trivial cases (these must also all be signed by the client and submitted under his or her name).
- The exclusive jurisdiction for any disputes that may arise with the customer in relation to the services offered by Assistenza Legale, in particular (but not limited to) invoicing, is the court of Mendrisio . The applicable law is Swiss law .
- The customer, expressly invited to read this information document, acknowledges having read its contents and accepts it .
